Terms of Service

1. Acceptance of Terms


By creating an account or accessing any features of CloudFam ("Service"), including our file hosting platform, pay-per-download system, or related tools, you agree to be legally bound by these Terms of Service ("Terms").
This agreement forms a contract between you and CloudFam, outlining your rights and obligations.
If you do not agree to all provisions—including updates—we request that you refrain from using the Service.
These Terms apply to all users, whether accessing the platform for personal use, business purposes, or as part of promotional activities, and cover interactions with our website, mobile applications, and any associated APIs.

2. User Accounts

2.1. Registration


To use CloudFam, you must be at least 18 years old or have reached the age of majority in your jurisdiction.
During registration, you are required to provide accurate, current, and complete information, such as your name, email address, and payment details where applicable.
This information helps us verify your identity and ensure a secure environment.
You are obligated to update this information promptly if it changes (e.g., a new email or address) to maintain account integrity and comply with legal requirements.

2.2. Account Security


You are fully responsible for maintaining the confidentiality of your password and any security questions or two-factor authentication codes associated with your account.
All actions performed under your account, including file uploads, downloads, or financial transactions, are your responsibility.
If you suspect unauthorized access—such as unusual login activity or unrecognized file changes—you must notify CloudFam immediately via our support portal at support@cloudfam.io to mitigate potential damage and secure your account.

3. Content Policy

You retain full ownership of the files you upload to CloudFam but are solely responsible for their content and legality.
By using the Service, you agree not to upload, store, or share any files that violate our policies or applicable laws.
Prohibited content includes, but is not limited to:

  • Adult, sexually explicit, or pornographic material, including images, videos, or text deemed inappropriate for general audiences.
  • Content that infringes upon any third party's copyright, patent, trademark, trade secret, or other proprietary rights, such as pirated software or unauthorized music downloads.
  • Files containing viruses, malware, trojans, ransomware, or any other malicious code that could harm users or our systems.
  • Material that promotes illegal activities, hate speech, violence, discrimination based on race, gender, religion, or ethnicity, or any form of harassment.
  • Content that is otherwise unlawful, fraudulent (e.g., fake documents), or harmful, such as scams or phishing attempts.

We reserve the right to monitor uploads, remove any content that violates these terms without prior notice, and take further action, such as account suspension, at our sole discretion.

4. Copyright & DMCA

CloudFam is committed to respecting intellectual property rights and fully complies with the Digital Millennium Copyright Act (DMCA) and other international copyright laws.
We have a dedicated process for handling notices of alleged copyright infringement.
If a copyright holder or their agent submits a valid DMCA notice—including details like the infringed work, location of the material, and contact information—we will promptly remove the allegedly infringing content and notify the uploader of the action taken.
Repeat infringers will have their accounts terminated to protect our platform's integrity.
The status of any DMCA action, including removal notices or counter-claims, will be visible in your user dashboard under the "DMCA" section, allowing you to respond or appeal if necessary.

5. Earnings & Payouts

5.1. Earning Calculation

You earn revenue based on the number of valid, unique downloads of your files hosted on CloudFam.
A "valid download" is counted only when a unique user completes the download process, excluding automated or fraudulent attempts.
Earnings are calculated using our tiered Payout Rates, which vary by the downloader's country to reflect regional demand and advertising revenue—e.g., higher rates for North America and Europe.
These rates are subject to change based on market conditions and will be updated on our Payout Rates page, accessible via your dashboard, with at least 30 days' notice.

5.2. Payouts

You may request a withdrawal of your earnings once your balance reaches the minimum threshold for your chosen payment method, such as $10 for PayPal or $50 for cryptocurrency.
Withdrawals are processed weekly, but all requests are subject to a review by our team to ensure compliance with these Terms.
We are not responsible for any fees charged by third-party payment processors (e.g., transaction fees by PayPal or network fees for crypto).
We reserve the right to delay or cancel any payout if we detect fraudulent activity, such as manipulated download counts, and will notify you with an explanation via email.

6. Traffic Source Verification

To maintain the integrity of our platform and protect our advertisers from invalid traffic, we reserve the right to place your account under a "Pending Validation" status at any time, especially if we detect unusual activity or high withdrawal requests.
During this period, your ability to request withdrawals will be paused, and you will be required to submit detailed information about your traffic sources—such as website URLs, marketing campaigns, or social media links—via the "Verification" page in your dashboard.
This process helps us ensure your traffic complies with our quality standards.
Failure to provide accurate or sufficient information within 14 days may result in your submission being rejected, potentially leading to account suspension until compliance is achieved.

7. Prohibited Activities

You agree not to engage in any of the following prohibited activities, which are designed to protect the platform's ecosystem and its users:

  • Generating downloads using automated means, such as bots, scripts, or click farms, to artificially inflate earnings.
  • Encouraging users to complete captchas or click links through deceptive means, such as misleading pop-ups or fake incentives.
  • Using the Service for any illegal purpose or in violation of any local, state, national, or international law, including money laundering or distributing controlled substances.
  • Attempting to interfere with or compromise the system integrity or security, such as hacking attempts, DDoS attacks, or exploiting vulnerabilities.

Violations may result in immediate account suspension, content removal, or legal action, depending on the severity, with notifications sent to your registered email.

8. Account Termination

We may suspend or terminate your account at our sole discretion, without prior notice, for any reason, including but not limited to a breach of these Terms, such as uploading prohibited content or engaging in fraudulent activities.
Suspension may be temporary (e.g., 30 days for minor infractions) or permanent, depending on the violation.
Upon termination, your right to use the Service will immediately cease, and we may permanently delete your files, account data, and earnings balance.
You will be notified via email, and in cases of termination, you may appeal through our support team within 7 days, providing evidence to contest the decision.

9. Disclaimers

The Service is provided on an "AS IS" and "AS AVAILABLE" basis, meaning we offer it without any explicit or implied warranties.
CloudFam makes no warranty that the service will be uninterrupted, timely, secure, or free from errors—e.g., temporary outages may occur due to server maintenance or unexpected issues.
We do not guarantee compatibility with all devices or browsers, though we strive to support the latest versions.
Your use of the Service is at your own risk, and we recommend regular backups of critical files stored on our platform.

10. Limitation of Liability

In no event shall CloudFam be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your access to or use of, or inability to access or use, the Service.
This includes, but is not limited to, loss of profits, data loss due to server issues, diminished business opportunities, damage to goodwill, or other intangible losses, even if we have been advised of the possibility of such damages.
Our liability is limited to the extent permitted by law, and any claims must be brought within one year of the incident, with a maximum recovery capped at the amount you paid us in the past 12 months.

11. Changes to Terms

We reserve the right to modify these Terms at any time to reflect changes in our services, legal requirements, or business practices—e.g., adding new features or updating payout policies.
We will notify you of any changes by posting the revised Terms on this page with a "Last Updated" date and may send an email notification to your registered address.
You are advised to review these Terms periodically, as continued use of the Service after changes constitutes your acceptance of the new Terms.
Significant changes, such as those affecting earnings or termination rights, will be highlighted for 30 days.
