Terms of Service
These Terms of Service (“Terms”) govern access to and use of the CloudFam platform and related services. By creating an account or using CloudFam, you acknowledge that you have read, understood, and agree to be bound by these Terms.

1. Agreement with CloudFam
CloudFam (“CloudFam”, “we”, “us”, or “our”) provides an online platform that enables users to upload, store, distribute and monetize digital files (the “Service”). These Terms constitute a legally binding agreement between you (“you”, “your”, or the “User”) and CloudFam.
By accessing or using the Service, creating an account, or clicking to accept or agree to these Terms, you represent that you have the legal authority to enter into this agreement. If you do not agree to these Terms, you must not use the Service.
2. Eligibility and Account
2.1 Eligibility
The Service is intended for individuals who are at least eighteen (18) years of age or the age of legal majority in their jurisdiction, whichever is higher. By using the Service, you represent and warrant that you meet this requirement.
2.2 Account Registration
To use certain features of the Service, you must create an account and provide accurate, complete and current information. You agree to promptly update your information as necessary to ensure it remains accurate and complete.
2.3 Account Security
You are solely responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to notify CloudFam immediately of any actual or suspected unauthorized use of your account or any other security breach. CloudFam is not liable for any loss or damage arising from your failure to safeguard your account credentials.
3. User Content and Uploads
3.1 Ownership of Content
You retain all rights, title and interest in and to the files and content you upload to the Service (“User Content”). Except for the limited license granted below, these Terms do not grant CloudFam any ownership rights to your User Content.
3.2 License to CloudFam
By uploading or otherwise making User Content available through the Service, you grant CloudFam a worldwide, non-exclusive, royalty-free license to host, store, reproduce, distribute, display, and perform such User Content solely for the purpose of operating, maintaining, improving and promoting the Service, and for fulfilling your monetization and delivery instructions.
3.3 Responsibility for Rights and Compliance
You are solely responsible for ensuring that you have all necessary rights, licenses and permissions to upload, share and monetize your User Content. You represent and warrant that your User Content, and your use of the Service, do not and will not infringe any intellectual property, privacy, publicity, or other rights of any third party and will not violate any applicable law or regulation.
3.4 Prohibited Content
You agree that you will not upload, store, share, or monetize any User Content that:
- infringes any copyright, trademark, trade secret, or other proprietary right, including unauthorized copies of software, games, movies, television shows, music, e-books, audiobooks, or other copyrighted works;
- contains pornography, sexually explicit material, or content primarily intended to provide sexual gratification;
- contains threats, harassment, hate speech, incitement to violence, or content that targets individuals or groups on the basis of race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristics;
- includes viruses, malware, spyware, or any other code, file or program designed to disrupt, damage or gain unauthorized access to systems, data or personal information;
- is otherwise illegal, fraudulent, or contrary to CloudFam’s policies, as updated from time to time.
3.5 E-books and Audiobooks
CloudFam recognizes that many creators use the Service to distribute e-books and audiobooks. As long as such files comply with these Terms and continue to receive legitimate user downloads, CloudFam will not automatically delete them solely due to age, storage duration, or routine housekeeping policies. Notwithstanding the foregoing, CloudFam reserves the right to remove any content where legally required, where necessary to protect the Service or its users, or where otherwise permitted under these Terms.
4. Prohibited Conduct
To protect the integrity of the Service, advertisers and other users, you agree that you will not, and will not enable or assist others to:
- generate or attempt to generate artificial traffic, including through the use of bots, automated scripts, incentivized downloads, fake referrals, VPN/proxy abuse, or any other means intended to manipulate download counts or earnings;
- mislead users about the nature, size, or contents of a file, including through deceptive file names, misleading descriptions, or false promises (e.g., “free gift”, “license key” or similar);
- interfere with or disrupt the operation of the Service or any connected network, including by probing, scanning or testing the vulnerability of our systems, circumventing access restrictions, or attempting to gain unauthorized access;
- resell, lease, or otherwise provide access to your account or the Service to any third party without CloudFam’s prior written consent;
- use the Service in a manner that could damage, disable, overburden, or impair the functioning or security of the platform.
CloudFam reserves the right to investigate any activity that it believes may violate these Terms or applicable law and to take any action it deems appropriate, including suspension or termination of your account.
5. Earnings and Payouts
5.1 Calculation of Earnings
Earnings are calculated based on valid, unique downloads in accordance with the payout rates and rules published on the Payout Rates page, which may be updated from time to time. A “valid” download generally refers to a unique user who completes the required process in compliance with CloudFam’s policies and any applicable advertiser requirements.
CloudFam reserves the right, in its sole discretion, to review and adjust reported downloads and earnings to exclude traffic that is fraudulent, suspicious, invalid, or in violation of these Terms or applicable law.
5.2 Thresholds and Payment Methods
You may request a payout once your account balance reaches the minimum threshold for your selected payment method. Minimum thresholds, supported methods and any associated fees are communicated within your account dashboard or on the website. Third-party payment processors (for example, PayPal or cryptocurrency networks) may charge additional fees, which are your responsibility.
5.3 Review and Compliance
All payout requests are subject to manual and/or automated review. CloudFam may temporarily withhold or adjust payouts pending review of traffic quality, fraud checks, compliance assessments, or other risk-based analysis. CloudFam may offset or withhold amounts from your earnings to correct prior overpayments, chargebacks, confirmed fraudulent activity, or other adjustments permitted under these Terms.
6. Copyright and DMCA
CloudFam respects intellectual property rights and expects its users to do the same. It is our policy to respond to clear notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act (“DMCA”) or applicable local law.
Upon receipt of a valid DMCA notice, CloudFam may remove or disable access to the identified content and, where appropriate, notify the account holder. Repeated copyright infringement or failure to respond appropriately to infringement notices may result in suspension or termination of your account.
Information on how to submit a notice or counter-notice is provided on our DMCA page. CloudFam is not required to be involved in disputes between rights holders and users beyond what is required by law.
7. Suspension and Termination
CloudFam may suspend, restrict, or permanently terminate your access to the Service, in whole or in part, at any time and without prior notice if:
- you breach or are suspected of breaching these Terms or any applicable policy;
- your activity presents a security, legal, operational, or reputational risk to CloudFam, its partners, or other users; or
- CloudFam is required to do so by law, regulation, court order, or governmental request.
Upon termination, your right to use the Service will immediately cease, and CloudFam may delete or restrict access to your User Content and account data in accordance with these Terms and applicable law. Where termination results from confirmed fraud, abuse, or material breach, any unpaid earnings may be permanently forfeited.
8. Disclaimers
The Service is provided on an “AS IS” and “AS AVAILABLE” basis, without warranties of any kind, whether express, implied, statutory, or otherwise. To the fullest extent permitted by law, CloudFam specifically disclaims all implied warranties, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
CloudFam does not warrant that the Service will be uninterrupted, secure, or error-free, that defects will be corrected, or that the Service or the servers that make it available are free of viruses or other harmful components. You are responsible for maintaining appropriate backups of your important data and for implementing appropriate security measures when using the Service.
9. Limitation of Liability
To the maximum extent permitted by law, in no event shall CloudFam, its affiliates, officers, directors, employees, agents, or licensors be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, loss of revenue, loss of data, or business interruption, arising out of or in connection with your use of or inability to use the Service, whether based on warranty, contract, tort (including negligence), or any other legal theory, even if CloudFam has been advised of the possibility of such damages.
To the extent permitted by applicable law, CloudFam’s total aggregate liability arising out of or relating to the Service or these Terms will not exceed the greater of (a) the amounts, if any, you have paid to CloudFam for access to the Service during the six (6) months immediately preceding the event giving rise to the claim, or (b) one hundred US dollars (USD $100).
10. Changes to These Terms
CloudFam may update or modify these Terms from time to time to reflect changes in the Service, legal or regulatory requirements, or business needs. When changes are made, the “Last Updated” date at the top of this page will be revised. For material changes, CloudFam may provide additional notice, such as by email or by displaying a notice within your account dashboard.
Your continued use of the Service after the effective date of any updated Terms constitutes your acceptance of those changes. If you do not agree to the modified Terms, you must discontinue use of the Service.
11. Content Storage and Retention
CloudFam provides file storage and delivery as part of the Service but does not offer a guaranteed, permanent archive for all files. Storage capacity, retention practices, and housekeeping routines may change over time to ensure performance, security, and cost-effectiveness.
Subject to Sections 3 and 7, CloudFam will not remove compliant e-book and audiobook files solely due to age or inactivity while they continue to receive legitimate downloads. Content may still be removed where required to comply with law, to enforce these Terms, to address abuse or technical issues, or where necessary for operational reasons.
Additional details regarding storage limits, housekeeping and retention may be communicated within your dashboard, in documentation, or in separate policies incorporated by reference into these Terms.
